When can the 16 hour exemption be used?

Answer

This exemption can be used if:

  1. The driver returned to the driver's work-reporting location, and the carrier has released the driver from duty at that location for the previous 5 duty tours the driver has worked;
  2. The driver has returned to the normal work-reporting location and the carrier releases the driver from duty within 16 hours after coming on duty following 10 consecutive off-duty
  3. The exemption has not been used in the past 6 consecutive day period, however, if the 34-hour restart has been completed the exemption can be used
  4. Exemption has to be selected within 16 hours of starting their day (must be within their 14 hour workday + 2 hours) to apply the exemption for that workday

  • A property-carrying driver is exempt from the 14 hour limit if:
    • 3. The driver has not taken this exemption within the previous 6 consecutive days, except when the driver has begun a new 7- or 8-consecutive day period with the beginning of any off-duty period of 34 or more consecutive hours as allowed by �395.3(c).
    • When enabled, the driver must select the 16hr exemption within 16hrs of starting their day (they must be within their 14hr workday +2hrs) to apply the exemption for that workday
